A site visit will take place before the pre-proposal conference, at 1399 Marin Street on 2/23/2023 at 10:00 am. For the 2/24/2023 virtual pre-proposal conference, participation is not mandatory but all prospective Proposers are encouraged to attend.
Requirements
  1. On July 1, 2014, the registration program under section 1725.5 of the California Labor Code went into effect. The program requires that all contractors and subcontractors who bid or work on a public works project register and pay an annual fee to the California Department of Industrial Relations (“DIR”).
  2. No contractor or subcontractor may be listed in a bid or awarded a contract for a public works project unless registered with the DIR as required by Labor Code section 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code section 1771.1(a)].
  3. The requirements of the Local Business Enterprise Ordinance set forth in Chapter 14B of the San Francisco Administrative Code as it now exists or as it may be amended in the future (collectively the “LBE Ordinance”) shall apply to this RFQP. To be eligible for award of this contract, Proposers must agree to comply with the following Local Business Enterprise (LBE) requirements authorized by San Francisco Administrative Code Chapter 12B, Section 12B.4, and Chapter 14B (where applicable), and their implementing Rules and Regulations
  4. For more information regarding the Contract Monitoring Division (CMD) requirements, see also Document 00 43 10 and Article 7 of this RFQP.
  5. Minimum wage rates for this project must comply with the current General Prevailing Wage as determined by the State Department of Industrial Relations. Minimum wage rates other than applicable to General Prevailing Wage must comply with San Francisco Administrative Code, Chapter 12P, Minimum Compensation Ordinance.
  6. In accordance with San Francisco Administrative Code Chapter 6, no proposal is accepted and no contract in excess of $1,000,000 is awarded by the City and County of San Francisco until such time as (a) the Department Head has recommended to the board or commission concerned a Contract for Award and (b) such board or commission has then adopted a resolution awarding the Contract. Pursuant to Charter Section 3.105, all contract awards are subject to certification by the Controller as to the availability of funds.
  7. Right reserved to reject any or all bids and waive any minor irregularities.
  8. Bidders are hereby advised that the Contractor to whom the Contract is awarded must be certified by the Contract Monitoring Division as being in compliance with the Equal Benefits Provisions of Chapter 12B of the Administrative Code within two weeks after notification of award.
  9. This Contract is subject to the requirements of Administrative Code Chapter 12X, which prohibits contracting in states with laws that allow discrimination. The City is prohibited from entering into any Contract with a Contractor that has its United States headquarters in a state on the Covered State List or where any or all of the work on the contract will be performed in any of those states on the Covered State List.   10. LBE Subcontracting Requirement for Design Services 11% Micro LBE, 7% Small LBE, 3% SBA LBE. LBE Subcontracting Requirement for Construction Services 13% Micro LBE, 6% Small LBE and 3% SBA LBE.   11. A Proposal may be rejected if the City determines that any of the bid item prices are materially unbalanced to the potential detriment of the City.
  12. This contract is subject to the San Francisco Citywide Project Labor Agreement. Refer to Appendix G of the Project Manual for more information.
